1. Who you are buying from
The seller is Modbox Container GmbH, Industriestraße 42, 28199 Bremen, Germany, registered at the Amtsgericht Bremen under HRB 38291 HB. Goods sold on the United States storefront are supplied from our yards in Los Angeles, CA; Pasadena, TX; and Elizabeth, NJ.
2. Prices
Prices on the US storefront are in US dollars and include delivery to a kerbside location in the contiguous United States (see Delivery in the United States). Prices exclude sales tax. Where we are required to collect sales tax for the delivery state, it is added to the invoice at the applicable rate and shown separately. The price on the product page at the time you place the order is the price you pay.
3. Ordering and payment
Placing an order through the storefront is a binding offer to buy. We confirm receipt by email immediately and send wire transfer instructions with a payment reference in a second email. The contract is concluded, and the unit reserved, when payment is received. Please do not send funds before you have received the instructions email. We do not take card payments for container orders.
4. Delivery
Delivery is kerbside by flatbed, tilt-bed or crane truck as the site requires, from the yard nearest the delivery address. You are responsible for confirming that the site can be reached by a heavy goods vehicle and that the unit can be placed where intended. Lead times are stated on the delivery page and confirmed when the delivery is booked. Where a delivery fails because the site is inaccessible, a re-delivery charge applies.
5. Title and risk
Title to the goods passes on receipt of payment in full. Risk passes on delivery.
6. Condition and warranty
New (one-trip) containers are supplied wind and watertight with a 12-month warranty against defects in materials and workmanship. Used containers are supplied in the grade stated on the product page (cargo worthy or wind and watertight), inspected before dispatch, and warranted wind and watertight on delivery. Cosmetic marks, surface rust and dents consistent with the stated grade are not defects. The warranty does not cover modification, misuse or damage after delivery.
7. Returns
Returns are governed by our Returns Policy (United States).
8. Liability
To the extent permitted by law, our liability for any claim arising from a sale is limited to the price paid for the goods. Nothing in these terms limits liability that cannot be limited by law.
9. Governing law
These terms are governed by the laws of the Federal Republic of Germany, without prejudice to any mandatory consumer protection that applies in the state of delivery.
